    Zero Tolerence Driving

    At this time I am in the process of being accused to be driving under the influence of Mary Jane. I was very corroborative with the police officer like any good medical marijuana patient would be. But he had an agenda and was bias towards me right off the bat. I let him arrest me and accuse me of my condition. Oh, I was not stoned or inebriated by any means. I even let them take my blodd while they took my plate and drivers license. I went to jail. I got out the next morning and the process started.

    When I went into court and pleaded no contest, not guilty the judge set up a trial day in March. When I showed up the Prosecutor didn't have his evidence, the blood test. Me myself I thought that was too bad but the court decided to delay the trial. Noiw by law the court is to see my case done and over with in 77 days per the law. The court went well beyond the time frame and I feel I am being vandusaled by the process of a quick trial.

    At this time I told the DA that I was not under the influence and that being a patient I will have THC in my system. He responded to me that the state has thia all messed up and he did not have any guide lines to follow as the law is so unclear.

    So being that, I do not plan on pleading guilty at all. I feel I was raped, used and abused by a self serving cop that night and it was him that was acting irrational and displaced as not knowing what to do but to treat it like I was drunk on alcohol.

    The scary part is that they are treating this like alcohol and giving me a 2nd offence. I feel that that isn't right either.

    Here is what really scares me. Michigan has a Zero Tolerance for being under the influence of any drug they deem being harmful and could cause the death of somebody or myself by using.

    When I talked to my lawyer and said that if I was on a legal medication prescribed by a legal doctor using the medication he prescribed could have been treated the same way. So if I was on lets say vicaden or a tobacco patch, that could also be considered under the influence and anyone using a drug while driving could be asked for a blood test if so decided by the police officer.

    By the way I passed all his tests on the road while his partner watched. The police officer called me a liar and a pot smoker who should obey the laws and play the game the right way...he was pissed off at me. I still don't get that one.

    Oh and the reason I got pulled over, my license plate light was out and he pulled me over for that. Not for speeding, not for a traffic violation just a light bulb on my florescent painted license plate that shines when light is put on it. Old Law with a twist of being thrown in jail.

    Well that is my story and my court date has not come up yet and is not till the end of may. This happened in January on my way back from my doctor in Ann Arbor traveling back home.

    So does anyone have any idea what the blood test will tell them?

    Wow, that sounds like a really fucked up situation. Some cops have that asshole egotistic agenda and have to spew all their lies they've learned over the years.

    I'm sure the blood test will show a higher than normal % of THC, thus they will probably prosecute you within the law.

    A good lawyer in these situations are a must.

    yeah, the test will tell them you had THC in your blood....Was just reading about the zero tolerance laws today and I think there absolutley bullsh*t.
    I smoke a joint today but dont drive until tomorrow and get pulled over then charged for a DUI? what the what??
    Makes no sense at ALL!
    Really wish I knew what to tell ya, like Nug said, get a good lawyer....they know the laws, the cops enforce what they think they know and a judge....well, guess it all depends on the judge.

    Charged zero tolerance driving offense in Hawaii?

    At first they charged me with DUI but I blew under (0.074) on the second breathalyzer test so I didn't get any DUI charges...I didn't have to post bail or have my license revoked. But I'm 19 so they charged me zero tolerance and I am to appear in court tomorrow. Any idea what will happen to me?
